Articles 31 to 33 of the Law on Foreign Nationals and International Protection set out the provisions for a short-term residence permit.
Articles 28 and 29 of the Executive Regulations of the Law on Foreign Nationals and International Protection also set out the provisions for short-term residence permits.
Which foreign nationals are granted short-term residence permits?
1- Foreign nationals who have come to the country for the purpose of scientific research
If a person applies for a residence permit for this purpose and is eligible for a permit for scientific research, he / she must obtain a permit from an institution and organization related to scientific research (Ministry of Culture and Tourism, Ministry of Energy, universities, etc.). If they are not eligible for a license, they must provide a statement of the subject matter of the investigation.
2- Foreign nationals who own real estate in Turkey
Foreign nationals who own real estate in Turkey, if they apply for a residence permit, the property must be residential and used for this purpose. Also, if the family members have a share and ownership right in the property in question, the family members can also apply for a residence permit.
3- Foreign nationals who intend to establish a business or business relationship
Foreign nationals intending to establish a business or business relationship will be asked for an invitation or similar documents prepared by the company or the person with whom they will contact if they apply for a residence permit for more than three months.
4- Foreign nationals who intend to participate in the in-service training program
Residence permits for this purpose will be issued for the duration of the training, based on documents and information about the place, duration and content of the training that will be provided by the organization or institution providing the in-service training.
5. Foreign nationals who have come to the country for educational purposes within the framework of a student exchange program or memoranda of understanding to which Turkey is a party and similar cases;
Foreign nationals who have applied for a residence permit for this purpose will be required to provide a form and information that will be received from the relevant organization.
The duration of the residence permit cannot be longer than the duration of the training and similar purposes.
In relation to students who have come in the form of a student exchange program (Erasmus, Rumi, Farabi, etc.); Those who have applied for public health insurance within three months from the date of first registration will not be asked for health insurance again. However, those who do not apply within three months of registration and lose their public health insurance premium will be required to have private health insurance.
6- Foreign nationals who will stay for tourism purposes
In this regard, the statements of foreign nationals who have applied for a residence permit for this purpose will be evaluated regarding their itinerary (such as where, when and for how long they will stay in the country). Documents and information will be requested if necessary.
7. Foreign nationals who will be treated provided they do not have any of the diseases that pose a threat to public health
Foreign nationals who have come to Turkey for this purpose will be asked to accept them from public and private hospitals. Health insurance will not be required from those who provide proof of payment of all their medical expenses.
The residence permit will be adjusted according to the duration of treatment.
Foreign nationals who are paid for accommodation, subsistence or medical expenses by government agencies and institutions during treatment will not be required to have valid health insurance and proof of financial status.
If necessary, the relevant hospital and government agencies and institutions may be asked for a form and information regarding the treatment of the foreigner.
The matters related to the residence permit of the companions of foreign nationals who have come to the country for the purpose of treatment in the form of existing health cooperation memoranda (unless there is a separate provision in the memorandum regarding the companion), will be done according to general rules.
Also, according to Article 14 of the Annex to the Basic Law on Health Services No. 3359, in the case of foreign nationals who have come to our country, companions who should not be more than two people, will not be required to apply for a residence permit, valid health insurance.
8- Foreign nationals who must reside in Turkey at the request and decision of judicial or administrative authorities
The duration of the residence permit that is regulated for this purpose will be adjusted taking into account the period mentioned in the decision or application.
9 – Foreign nationals who have lost the necessary conditions for a family residence permit and their residence will become a short-term residence
10- Foreign nationals who intend to participate in Turkish language courses
Foreign nationals who have applied for a residence permit for this purpose and are registered in an organization that is qualified to provide Turkish language training will be granted a residence permit at most twice.
If the duration of the training course is less than one year, the duration of the residence permit cannot be longer than the duration of the training course. The institution offering the training course is obliged to inform the provincial administration about the status of the start of training and the presence and absence of a foreigner who has registered for Turkish language training.
11 – Foreign nationals who intend to study, research, internship and participate in training courses in Turkey through government institutions
A residence permit issued for this purpose cannot be longer than one year. Foreign nationals whose accommodation, subsistence or medical expenses are paid by government agencies will not be required to have valid health insurance and proof of financial status. Documents and information may be requested from organizations.
12- Foreign nationals who have referred to higher education in Turkey within six months from the date of their graduation
Foreign nationals who have applied for a residence permit for this purpose will only be allowed to stay for a maximum of one year if they apply within six months of their date of graduation.
13. People who do not intend to work in Turkey but intend to invest in the form and amount determined by the Council of Ministers and his foreign spouse as well as his own child or his spouse who is under eighteen years old and needs care.
For foreign nationals who intend to obtain a residence permit for this purpose, the residence permit is set at a maximum of five years.
The amendment introduced by International Labor Law No. 6735 to Law No. 6458 aims to encourage foreign nationals who contribute to the country’s economy and to facilitate the residence permit of these foreign nationals.
14. Foreign nationals, citizens of the Turkish Republic of Northern Cyprus
Foreign nationals who have applied for a residence permit for this purpose will be issued a residence permit for a maximum period of five years.
Is a short-term residence permit adjustable for how many years?
Short-term residence permits, except for foreign nationals mentioned in Articles 13 and 14 above, can be adjusted at any time for a maximum of two years.
What are the requirements for a short-term residence permit?
To apply for a short-term residence permit, foreign nationals must meet the conditions set forth in Article 32 of the Law.
